ROYAL COMMISSIONS MUST BE ABOVE SUSPICION — PROCESS MATTERS

Royal Commissions do not exist merely to uncover facts. They exist to restore public confidence when trust has been shaken. That is why perception matters almost as much as integrity itself.
The appointment of former High Court Justice Virginia Bell AC to lead the Royal Commission into the Bondi terror attack and the broader issue of antisemitism has prompted legitimate public debate. Not because of any allegation of bias or impropriety — there is none — but because of relationships, optics, and process.
Let’s be clear at the outset: Virginia Bell is a distinguished jurist. She served on the High Court of Australia from 2009 to 2021, was previously a judge of the NSW Supreme Court, and has been entrusted with sensitive inquiries before, including the investigation into former Prime Minister Scott Morrison’s secret ministerial appointments. Her legal credentials are not in dispute.
However, Royal Commissions are not ordinary inquiries. They operate in politically charged environments, often intersecting with national security, social cohesion, and government accountability. In such circumstances, confidence in independence must be unquestionable.
Ms Bell was appointed to the High Court by a Labor government under Kevin Rudd in 2009. She was formally recognised under another Labor government in 2012 for her service to the law and public policy. She has now been appointed by the Albanese government to lead one of the most sensitive Royal Commissions in recent years.
None of this establishes bias. Appointment by governments of the day is standard constitutional practice. But it does establish proximity, and proximity creates perception — especially when the appointing government is itself a stakeholder in the outcomes, policy responses, and narrative framing of the inquiry.
That perception risk is heightened by the Prime Minister’s public insistence that Ms Bell is “the most qualified person” for the role. This claim is unnecessary and unconvincing. Australia has no shortage of eminent, independent, and nationally respected figures capable of leading such an inquiry.
Among those widely regarded as equally qualified are:
• Robert French, former Chief Justice of the High Court
• James Allsop, former Chief Justice of the Federal Court
• Dennis Richardson and Duncan Lewis, former national security chiefs with deep counterterrorism expertise
• Justice Michael Lee, a Federal Court judge respected across communities, including within parts of the Jewish community
The existence of multiple credible candidates does not diminish Ms Bell — but it does raise an important question: why was there no transparent or consultative selection process?
In other Westminster democracies, appointments to inquiries of this sensitivity often involve parliamentary consultation or confirmation mechanisms. In Australia, the executive alone decides. That may be lawful, but it is no longer sufficient in an era of declining trust.
A Senate-based or bipartisan selection process would not weaken Royal Commissions — it would strengthen them. It would shield commissioners from politicised attacks, reassure affected communities, and protect findings from claims of narrative management or institutional self-interest.
Some critics have mocked concerns about perception as “politicisation.” In fact, the opposite is true. Ignoring perception is what politicises an inquiry. Transparency disarms suspicion; secrecy feeds it.
This debate is not about Virginia Bell’s integrity. It is about process integrity.
If Royal Commissions are to retain their authority in a divided and sceptical society, governments must accept a simple principle: being independent is not enough — independence must be seen to be beyond question.
That is not an attack on the commissioner. It is a call to modernise how Australia appoints those entrusted with its most serious national inquiries.”
